Terms of Use:
SIA Sarunāts, REG.NR: 40203388990, ADDRESS: Liedes iela 28-35, Riga, LV-1029, hereinafter referred to as the internet store, provides the available content on the website and offers goods/services in accordance with the Terms of Use outlined below.
- General Terms
If a consumer purchases goods/services using the website as an intermediary, such an agreement is considered a Distance Contract and is subject to the laws of the Republic of Latvia, including but not limited to the Consumer Rights Protection Law of the Republic of Latvia, Cabinet Regulations "Distance Contract Regulations," etc.
- Making a Purchase
The prices and specifications of products sold in the online store are indicated alongside the products.
To place an order, add the desired products to the shopping cart. Fill in all necessary fields and choose the most suitable delivery method. The total cost of the order with delivery will then be displayed on the screen. Proceed with the payment to complete the order.
- Payment Terms
The currency of payment on the website is Euro. Orders can be paid for by selecting the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:
Include only those payment methods that your online store will use:
- Via bank transfer.
- With a bank card or internet banking via Makecommerce.
- With a bank card or internet banking via Paysera.
- Through PayPal.
The contract becomes effective upon successful payment to the internet store's bank account. If, for any reason, it is not possible to fulfil the order, the Buyer will be informed, and the paid amount will be refunded as soon as possible but no later than 14 days after receiving the notification.
- Delivery Terms
Delivery options:
- To Omniva parcel locker.
- To Venipak parcel locker.
- To DPD parcel lockers or pickup points.
- By DPD courier.
Goods are delivered only within the territory specified by the Seller (Latvia). www.myhero.lv accepts orders only if the entered delivery address is within the specified territory. Goods are delivered according to the delivery method chosen by the Buyer. All fees and taxes required to receive the shipment at the delivery destination must be covered by the Buyer. Delivery costs are displayed before order confirmation. Purchased goods are delivered to the address specified by the Buyer within 1-5 working days. In exceptional cases, we reserve the right to dispatch goods within 45 calendar days, notifying the customer accordingly.
- Right of Withdrawal
The Buyer has the right to withdraw from the purchase within 14 calendar days from the moment of receiving the goods. (Depending on the product, the Buyer may not have mandatory withdrawal rights, in which case the reason must be clearly stated and explained). The right of withdrawal does not apply if the Buyer is a legal entity.
To exercise the 14-day right of withdrawal, the goods may only be used for their intended purposes, and the consumer is responsible for maintaining the quality and safety of the goods during the withdrawal period. If the goods are improperly used or damaged, if the goods are negligently handled or instructions are not followed, if the original packaging of the goods is lost, or if the packaging is significantly damaged, the online store has the right to reduce the refunded amount in accordance with the decrease in the value of the goods.
To exercise the right of withdrawal, you must submit a withdrawal form, which can be found here: withdrawal form, by sending it to the email address ([email protected] within 14 days of receiving the goods. It is good practice to provide the customer with the option of returning the goods without additional charge. This will increase trust in the online store and help improve sales volumes.
The next sentence is intended for online stores that cannot offer the option of free product returns. The Buyer bears the cost of returning the goods, except in cases where the reason for the return is that the product does not match the order (for example, incorrect or damaged product).
It is the Buyer's obligation to return the Goods to the Seller without delay but no later than 14 days after sending the withdrawal form to the online store. After receiving the returned goods, the online store will immediately, but no later than 14 days, refund all payments received from the Buyer based on the Distance Contract.
The Seller has the right to withhold payment until the Goods are received from the Buyer or confirmation of the return of the goods is received. If the Buyer has chosen a different shipping method than the cheapest one offered by the online store, the online store is not obliged to compensate for the additional shipping costs.
The online store is not responsible for delays or non-fulfillment of obligations or any other non-performance caused by circumstances and obstacles beyond the reasonable control of the online store.
The online store reserves the right to refuse to sell goods and request their return from the Buyer if the price stated on the website is significantly lower than the market price due to errors.
- Consumer Rights for Non-Conforming Goods
The online store is responsible to the Buyer for the non-compliance of the goods sold with the contract terms or defects that occur within 6 months from the date of delivery of the goods to the customer or at the time of delivery, if such assumption does not contradict the properties or defects of the item. The Buyer must notify the Seller of the non-conformity of the goods immediately, within 2 months from its detection, i.e., file a complaint. The Buyer can file a complaint by contacting the online store, writing to [email protected], or contacting us on the website.
The online store is not responsible for defects that arise after the delivery of the goods to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to demand the elimination of the defects of the goods or their replacement with new goods free of charge.
If the goods cannot be repaired or replaced, the Seller refunds all payments to the Buyer in accordance with the Distance Contract. The Seller provides a written response to the consumer's complaint within 15 days.
- Processing of Buyer's Personal Data
The online store processes only those personal data that the buyer enters when ordering goods, such as name, surname, email, etc.
The online store transfers personal data to the transport service provider(s) to ensure the delivery of goods.
If you have explicitly agreed to receive our marketing communications, including newsletters, we may occasionally contact you by sending information about our services and latest offers. For this purpose, we may process your email address provided when subscribing to marketing communications. The Buyer has the option to opt out of marketing communications by notifying us, writing to [email protected], or contacting us on the website.
- Dispute Resolution Procedure
In matters not covered by these terms and conditions, the Buyer and the Seller undertake to comply with the laws of the Republic of Latvia.
The parties resolve all disputes between the Seller and the Buyer through mutual negotiations or written communication. If the dispute cannot be resolved through negotiations or written communication, the parties resolve disputes in the courts of the Republic of Latvia in accordance with the laws of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be referred for resolution to the Consumer Rights Protection Center or the courts of the Republic of Latvia.
The Buyer also has the right to appeal to the dispute resolution bodies of the European Union.
